1. About MyWillMate
MyWillMate is an online platform that helps users prepare a Will based on information they provide through a guided form. After you complete the form and make payment, we review your submission, draft your Will, and send it to you for signing.
MyWillMate is operated by an individual sole trader in New Zealand (“we”, “us”, “our”). We are not a law firm, and we do not provide legal advice. Our service is limited to preparing documents based on the information you provide.
2. Eligibility
To use MyWillMate, you must:
Be at least 18 years of age.
Hold assets in New Zealand or Australia.
Be of sound mind and capable of understanding the nature and effect of making a Will.
By using this website, you confirm that you meet these conditions.
3. How the Service Works
You complete the guided online form, which includes explanations and examples to help you understand each question.
Once you submit the form and payment is received, our team reviews your responses and prepares your draft Will.
Your completed Will is delivered to you electronically, along with instructions on how to sign and witness it properly under New Zealand and Australian law.
If we identify that your situation is too complex for an online Will, we may contact you to recommend obtaining legal advice instead of proceeding with our service. Any payment will be refunded at that time.
4. Pricing and Payment
Single Will - $149 NZD.
All prices are in New Zealand Dollars and inclusive of GST (if applicable). Payment is required upfront via Stripe before your Will is drafted.
We reserve the right to change our prices at any time. Changes do not affect orders that have already been paid for.
5. No Legal Advice
MyWillMate is not a law firm and does not provide legal advice. The information on our website and in our forms is general in nature and should not be relied upon as legal advice for your specific circumstances.
If you are uncertain about any aspect of your estate, property, or relationships, you should seek independent legal advice before using this service.
6. Accuracy of Information
You are solely responsible for ensuring that the information you provide through the MyWillMate form is accurate and complete. We rely entirely on your responses to prepare your Will.
If incorrect or incomplete information leads to an invalid or ineffective Will, MyWillMate will not be liable for any resulting loss or consequence.
7. Delivery of Your Will
Once your Will is drafted, it will be delivered electronically to the email address you provide, in pdf form. You are responsible for printing, signing, and witnessing your Will according to the instructions provided.
MyWillMate does not keep or store a signed copy of your Will.
8. Refund Policy
Because each Will is custom-prepared based on your information, we generally do not offer refunds once work has begun on your document.
However, if you contact us before we start drafting your Will, we may, at our discretion, offer a partial or full refund.
9. Privacy and Data Use
Your privacy matters. We collect only the information required to prepare your Will and deliver the service. We will not sell, rent, or disclose your personal data to third parties except as required by law.
By using our website, you consent to the collection and handling of your personal information in accordance with our Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by law:
MyWillMate provides its services on an “as is” and “as available” basis.
We make no guarantees about the suitability, completeness, or effectiveness of your Will for your specific circumstances.
We are not liable for any loss, damage, or cost (whether direct, indirect, incidental, or consequential) arising from your use of our website or services.
If liability cannot be excluded by law, our total liability to you is limited to the amount you paid for the service.
11. Intellectual Property
All website content, including text, graphics, design, and software, belongs to MyWillMate. You may not copy, distribute, or reproduce any part of this site or its materials without our written permission.
12. Changes to These Terms
We may update these Terms from time to time. The latest version will always be available on our website and will apply immediately upon publication.
13. Governing Law
These Terms are governed by and interpreted according to the laws of New Zealand, and you submit to the exclusive jurisdiction of the courts of New Zealand.
